1. Definitions

• Account: your Traxsy account, including the anonymous account the app creates if you continue without signing up.
• Content: the data you log, enter or upload through the Service.
• Traxsy Pro: optional paid features (currently Pen Split, Maintenance Mode and Custom schedule), sold as in-app purchases: a Monthly or Yearly auto-renewable subscription, or a one-time Lifetime purchase.
• App Store: Apple's App Store. Traxsy is an iPhone app with a companion Apple Watch app.

2. Acceptance of these Terms

By creating an account, continuing without one, or otherwise using the Service, you agree to these Terms. Our Privacy Policy explains how we handle your personal data. If you do not agree, do not use the Service.

3. Eligibility

You must be at least 16 years old, or older where your country sets a higher age for digital consent, and able to enter into a binding contract.

4. Your account

You agree to:

• Give accurate information when you register.
• Keep your sign-in details confidential. You are responsible for activity under your account.
• Tell us promptly at support@traxsyapp.com if you suspect someone else has accessed your account.

We may suspend or close accounts that break these Terms or the law.

5. The Service

Traxsy is a personal tracking tool for people taking GLP-1 medicines. You can log doses, injection sites, side effects, weight, food and water, and review your entries in charts and summaries. We may add, change or remove features over time.

6. No medical advice

Traxsy is not a medical device. The Service is for informational purposes only. It is not intended to diagnose, treat, cure or prevent any disease or condition. Charts, calculations and estimates are approximations and may be inaccurate.

The estimated medication level is calculated from the doses you log and published label averages. It is an estimate, not a blood level: do not use it to decide when or how much to take. Pen Split click counts are estimates, not manufacturer instructions, and some pens' Instructions for Use say not to set a dose by counting clicks. Always take your medicine exactly as prescribed and follow its official labelling and Instructions for Use.

Always consult a qualified healthcare professional before making medical decisions. Do not rely on Traxsy instead of professional medical advice. In an emergency, contact your local emergency services immediately.

7. Traxsy Pro and billing

Core tracking in Traxsy is free. Traxsy Pro is an optional in-app purchase sold through the App Store, as a Monthly or Yearly auto-renewable subscription or as a one-time Lifetime purchase. Prices are shown in the app and on the App Store before you buy.

Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period; manage or cancel them in your Apple Account settings. The Lifetime purchase is a single payment and never renews. Any free trial is an App Store introductory offer and is shown before you confirm a purchase. Use Restore Purchases in the app to restore a purchase on another iPhone signed in to the same Apple Account.

8. Refunds and cancellation

App Store purchases are made from Apple and are subject to Apple's terms, including any right to cancel a purchase that Apple offers in your country. Refunds are handled by Apple at reportaproblem.apple.com; we can't issue refunds for App Store purchases ourselves.

You can cancel a subscription at any time. Cancellation takes effect at the end of the current billing period, and your data stays available on the free tier afterwards.

9. Your content

You keep all rights to your content. You give us a worldwide, non-exclusive, royalty-free licence to host, store, transmit and display it solely to operate the Service for you.

10. AI features

The current version of Traxsy doesn't include AI features. If a future version adds them, we will update these Terms and the Privacy Policy before they become available.

11. Intellectual property

The Service, including its software, design, text and graphics, belongs to us or our licensors. Subject to these Terms, you receive a limited, personal, non-transferable, revocable licence to use it for its intended purpose.

Ozempic®, Wegovy®, Rybelsus®, Victoza® and Saxenda® are trademarks of Novo Nordisk A/S. Mounjaro®, Zepbound® and Trulicity® are trademarks of Eli Lilly and Company. Traxsy is not affiliated with or endorsed by them.

12. Acceptable use

You agree not to:

• Use the Service to break any law or regulation.
• Try to access another user's account or data.
• Reverse engineer or decompile the Service, except where the law allows it.
• Interfere with the Service's security, integrity or performance.
• Use the Service to harass, threaten or harm others.
• Resell, sublicense or commercially exploit the Service.

13. Third-party services

The Service relies on third-party services such as Apple's App Store and, if you choose them, Sign in with Apple and Google Sign-In. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them.

14. Disclaimers

EXCEPT AS EXPRESSLY PROVIDED IN THESE TERMS AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRAXSY AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES.

OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US$100.

Nothing in these Terms excludes or limits liability for (i) death or personal injury caused by negligence, (ii) fraud or fraudulent misrepresentation, or (iii) any other liability that cannot be excluded or limited under applicable law.

16. EU and UK consumer rights

If you are a consumer living in the EU/EEA or the UK, you benefit from the mandatory consumer-protection laws of your country. Nothing in these Terms limits those rights.

17. Indemnification

To the extent the law allows, you agree to indemnify us against claims, losses and expenses arising from (a) your use of the Service in breach of these Terms, (b) your content, or (c) your violation of anyone else's rights.

18. Termination

You can stop using the Service at any time and delete your account in the app: Settings → Privacy & Legal → Delete account. We may suspend or end your access if you materially breach these Terms or if the law requires it. Sections that by their nature should survive termination will survive.

19. Dispute resolution

We'd like to resolve any dispute informally first, so please contact us at legal@traxsyapp.com. If we can't resolve it, either of us may take it to the courts identified in Section 20, unless mandatory consumer law lets you bring a claim where you live.

20. Governing law

These Terms are governed by the laws of [Country or state whose law governs these Terms], without regard to conflict-of-law rules. If you are a consumer, you keep the protection of the mandatory laws of the country where you live.

21. Miscellaneous

• Severability: if a provision is held unenforceable, the rest remains in effect.
• No waiver: not enforcing a provision is not a waiver of it.
• Entire agreement: these Terms, the EULA and the Privacy Policy are the entire agreement about the Service.
• Assignment: you may not assign these Terms without our consent. We may assign them as part of a merger, acquisition or sale of assets.
• Force majeure: neither of us is liable for delays caused by events beyond reasonable control.
• Notices: we may give you notice by email to the address on your account or by publishing it on this page.

22. Changes to these Terms

We may update these Terms. We'll publish the new version on this page and change the effective date at the top. If a change materially affects your rights, we'll give you notice before it takes effect, for example by email if we have your address. If you keep using the Service after a change takes effect, the updated Terms apply.
