End User Licence Agreement

1. The Agreement

This EULA applies to the App and to any updates, supplements, internet-based services and support services we provide for it. It is in addition to, and incorporates by reference, our Terms & Conditions and Privacy Policy.

2. Acknowledgement

You acknowledge that this EULA is concluded between you and Traxsy only, and not with Apple Inc. ("Apple"). Traxsy, not Apple, is solely responsible for the App and its content. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.

3. Scope of Licence

Traxsy grants you a non-transferable licence to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions. This EULA governs any content, materials or services accessible from or purchased within the App, and upgrades provided by Traxsy that replace or supplement the original App, unless an upgrade comes with a separate licence, in which case that licence governs.

You may not distribute or make the App available over a network where it could be used by multiple devices at the same time. You may not transfer, redistribute or sublicense the App.

4. Traxsy Pro purchases

Traxsy Pro is sold as in-app purchases through the App Store. It unlocks the Pro features listed on the purchase screen at the time of purchase; currently Pen Split, Maintenance Mode and Custom schedule.

4.1 Available plans

• Traxsy Pro · Monthly: auto-renewable subscription, billed every month. The price is shown in the App and on the App Store before you buy, in your local currency where supported.
• Traxsy Pro · Yearly: auto-renewable subscription, billed every year. The price is shown in the App and on the App Store before you buy, in your local currency where supported.
• Traxsy Pro · Lifetime: one-time (non-consumable) purchase. You pay once; it does not renew and is not a subscription. The price is shown in the App and on the App Store before you buy.
• Free tier: core tracking features are available at no cost and require no purchase.

4.2 Renewal terms (Monthly and Yearly)

Payment is charged to your Apple Account at confirmation of purchase. A subscription renews automatically unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period, at the price of the selected plan. You can manage subscriptions and turn off auto-renewal in your Apple Account settings after purchase. The Lifetime purchase is charged once and never renews.

4.3 Free trials

If a free trial is offered as an App Store introductory offer on the Monthly or Yearly subscription, it is shown on the purchase screen before you confirm. The trial converts to a paid subscription at the end of the trial period unless you cancel at least 24 hours before it ends. Any unused portion of a free trial is forfeited if you buy a subscription before the trial ends.

4.4 Cancellation

You can cancel a subscription at any time on your iPhone in Settings → [your name] → Subscriptions. Cancellation takes effect at the end of the current billing period, and you keep Traxsy Pro until then. After that, your data stays available on the free tier.

4.5 Restoring purchases

To use Traxsy Pro on another iPhone, sign in with the same Apple Account and tap Restore Purchases in the App.

4.6 Refunds

Refunds for App Store purchases are handled by Apple under Apple's refund policies; Traxsy cannot refund App Store purchases directly. To request a refund, visit reportaproblem.apple.com.

5. Use of Data

The App sends the data described in our Privacy Policy to our backend so that your records can sync and be restored. The App contains no third-party analytics, advertising or tracking SDKs. If you have chosen to share analytics with app developers in your device settings, Apple may give us crash reports and aggregated statistics that do not identify you, which we use to fix problems and improve the App.

6. Termination

This EULA is effective until terminated by you or Traxsy. Your rights under this EULA end automatically, without notice from Traxsy, if you fail to comply with any of its terms. When this EULA ends, you must stop all use of the App and destroy all copies, full or partial, of the App.

7. External Services

The App may give access to Traxsy's and third parties' services and websites ("External Services"). You use External Services at your sole risk. Traxsy is not responsible for examining or evaluating the content or accuracy of third-party External Services and is not liable for them. Information displayed by the App or an External Service, including medication-level estimates, BMI and other calculations, is for general informational purposes only and is not guaranteed by Traxsy or its agents. The App is not a medical device. Always consult a qualified healthcare professional before making medical decisions.

8. No Warranty

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT USE OF THE APP IS AT YOUR SOLE RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP AND ANY SERVICES PERFORMED OR PROVIDED BY THE APP ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, AND TRAXSY HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE APP AND ANY SERVICES, EITHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND OF NON-INFRINGEMENT OF THIRD-PARTY RIGHTS.

9. Limitation of Liability

TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL TRAXSY BE LIABLE FOR PERSONAL INJURY OR ANY INCIDENTAL, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT OR OTHERWISE) AND EVEN IF TRAXSY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In no event shall Traxsy's total liability to you for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the amount you paid to Traxsy for the App in the twelve (12) months before the event giving rise to liability, or US$50, whichever is greater. Nothing in this EULA limits liability that cannot be limited under applicable law.

10. Export Compliance

You may not use or otherwise export or re-export the App except as authorised by United States law and the laws of the jurisdiction in which the App was obtained. In particular, but without limitation, the App may not be exported or re-exported (a) into any U.S.-embargoed countries or (b) to anyone on the U.S. Treasury Department's Specially Designated Nationals List or the U.S. Department of Commerce Denied Persons List or Entity List. By using the App, you represent and warrant that you are not located in any such country or on any such list.

11. Apple as Third-Party Beneficiary

You and Traxsy acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this EULA, and that, upon your acceptance of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.

If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you (if any). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be Traxsy's sole responsibility.

Traxsy, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar legislation.

If a third party claims that the App or your possession and use of the App infringes that third party's intellectual property rights, Traxsy, not Apple, will be solely responsible for the investigation, defence, settlement and discharge of that claim.

12. Intellectual Property

The App, its content, features and functionality are owned by Traxsy or its licensors and are protected by copyright, trademark and other intellectual property laws.

Ozempic®, Wegovy®, Rybelsus®, Victoza® and Saxenda® are trademarks of Novo Nordisk A/S. Mounjaro®, Zepbound® and Trulicity® are trademarks of Eli Lilly and Company. Traxsy is not affiliated with or endorsed by them.

13. Legal Compliance and Third-Party Terms

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

You must comply with any third-party terms that apply when you use the App, such as your wireless data service agreement.

15. Changes to this EULA

Traxsy may revise this EULA from time to time. We'll publish the new version on this page and change the effective date at the top. If a change materially affects your rights, we'll give you notice before it takes effect, for example by email if we have your address. If you keep using the App after a change takes effect, the revised EULA applies.
